Court of Appeals Benesowitz Decision

On June 27, 2007, the New York Court of Appeals issued a decision in Benesowitz v. Metropolitan Life Insurance Company relating to the denial of benefits for a group disability claim for a pre-existing condition. The Court applied a new interpretation of existing New York Law. If you are a New York claimant and have had a group disability claim denied after June 27, 2004 because of a pre-existing condition you may be eligible to have your previously denied claim reviewed. You can send a written appeal to:

We are automatically undertaking a re-examination of group disability claims denied based upon pre-existing conditions after June 27, 2004 and we will be contacting the affected insured's concerning the review and whether disability benefits are to be paid.
